Terms of Service

Effective date: January 18, 2026

AirCongo is operated by ExpressCarCab, a Delaware C-Corp (“Company”, “we”, “us”). By accessing or using AirCongo (the “Service”), you agree to these Terms of Service (“Terms”). If you do not agree, do not use the Service.

1. The Service

AirCongo provides a platform where users can post trips, request package delivery, communicate, and complete transactions. We do not provide transportation services ourselves and we are not a carrier. Users are responsible for their interactions, agreements, and compliance with laws.

2. Eligibility

  • You must be at least 18 years old to use the Service.
  • You must provide accurate information and keep your account secure.
  • We may require identity verification for travelers and certain features.

3. User Responsibilities

  • Accuracy: You agree to provide truthful, accurate, and complete information.
  • Compliance: You must comply with all applicable laws, customs rules, and regulations.
  • Prohibited items: You must not use the Service to transport illegal, dangerous, or restricted items.
  • Safety: You are responsible for safe packaging, delivery coordination, and lawful behavior.
  • No misuse: No harassment, fraud, spamming, or attempts to exploit the platform.

3A. Prohibited Items and Package Inspection

Senders must never request transport of illegal, restricted, or dangerous items (including drugs, weapons, explosives, hazardous materials, counterfeit goods, or any item prohibited by law, airline rules, or customs). Senders are solely responsible for the contents of packages and for compliance with all applicable laws.

Travelers have the right to ask questions, request inspection (including opening a package) before accepting it, and to refuse any package that appears suspicious or unsafe. If prohibited items are suspected, we may suspend accounts and cooperate with law enforcement.

4. Prohibited Content and Conduct

You may not:

  • Post illegal content or engage in unlawful activity.
  • Use the Service for scams, fraud, or misleading representations.
  • Transmit harmful code, attempt unauthorized access, or disrupt the Service.
  • Harass, threaten, or discriminate against other users.

5. Payments

Payments may be processed by third-party processors (e.g., Stripe). By making payments through the Service, you agree to the payment processor’s terms. Fees may be non-refundable except where required by law or stated in our Refund & Cancellation Policy.

6. User-to-User Transactions

AirCongo is a platform. Any agreement is between users. We are not responsible for:

  • The quality, legality, safety, or delivery of packages.
  • User conduct or statements.
  • Losses arising from user-to-user interactions.

7. Identity Verification

We may require travelers to complete verification (including document checks). Verification does not guarantee a user’s behavior or performance.

8. Account Suspension and Termination

We may suspend or terminate your account if we believe you violated these Terms, engaged in fraud, or created risk for the Service or other users. You may stop using the Service at any time.

9. Disclaimers

The Service is provided “as is” and “as available”. To the maximum extent permitted by law, we disclaim all warranties, express or implied, including fitness for a particular purpose and non-infringement.

10. Limitation of Liability

To the maximum extent permitted by law, ExpressCarCab and AirCongo will not be liable for indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill.

11. Indemnification

You agree to defend, indemnify, and hold harmless ExpressCarCab and its affiliates from claims arising out of your use of the Service, your transactions, your content, or your violation of these Terms or applicable laws.

12. Changes to the Service and Terms

We may modify the Service or these Terms at any time. We will update the “Effective date”. Continued use after changes means you accept the updated Terms.

13. Governing Law

These Terms are governed by the laws of the State of Delaware, without regard to conflict of laws principles, except where prohibited by applicable law.
